General Administration of Customs: Allow the import of Romanian wild aquatic products that meet relevant requirements

CCTV news: According to the "Customs Release" public account, the General Administration of Customs announced on April 15 that in accordance with my country's laws and regulations and the provisions of the General Administration of Customs of the People's Republic of China and the National Veterinary Health and Food Safety Authority of Romania on the inspection and quarantine requirements for Romanian wild aquatic products exported to China, from now on, the following relevant requirements are allowed: Import of Romanian wild aquatic products:

1. Inspection and quarantine basis

(1) "Food Safety Law of the People's Republic of China" and its implementation regulations, "Entry and Exit Animal and Plant Quarantine Law of the People's Republic of China" and its implementation regulations, "Import and Export Commodity Inspection Law of the People's Republic of China" and its implementation regulations.

(2) "Measures of the People's Republic of China on the Safety Management of Imported and Exported Food" and "Regulations of the People's Republic of China on the Registration and Management of Overseas Production Enterprises of Imported Food".

(3) "Protocol between the General Administration of Customs of the People's Republic of China and the National Veterinary Health and Food Safety Authority of Romania on Inspection and Quarantine Requirements for Wild Aquatic Products Exported to China" (hereinafter referred to as the "Protocol").

II. Scope of imported products

Wild aquatic products refer to wild aquatic animal products and their products for human consumption, algae and other marine plant products and their products, excluding amphibians, reptiles, aquatic mammals, live aquatic animals and aquatic animal and plant breeding materials.

3. Requirements for Production Enterprises

Enterprises producing wild aquatic products exported to China (including production, processing, and storage enterprises) should obtain approval from the Romanian side and be effectively supervised by it. The food safety and hygiene management and protection system of production enterprises should comply with the requirements of China’s relevant laws and regulations on food safety.

According to the "Food Safety Law of the People's Republic of China" and its implementation regulations, the "Entry and Exit Animal and Plant Quarantine Law of the People's Republic of China" and its implementation regulations, wild aquatic product production enterprises exported to China should be recommended to China by Romania for registration. No export to China is allowed without registration.

Romania can recommend to China a list of manufacturing companies that apply for registration in China through "list registration" and attach registration application materials in accordance with relevant regulations. Enterprises on the list that meet the requirements after review will be registered; those that do not meet the requirements will not be registered.

IV. Requirements for imported products

Romania should ensure that wild aquatic products exported to China meet the following conditions:

(1) Legally fished in domestic or international waters.

(2) The raw materials and products do not have the following conditions:

1. Romania’s wild aquatic products that have been exported or planned to be exported to China violate China’s relevant laws and regulations on food safety, national standards and the provisions of the Protocol, and have seriously affected the safety of wild aquatic products exported to China.

2. The occurrence of aquatic animal diseases in Romania that are listed in the "List of Quarantine Diseases for Imported Animals of the People's Republic of China" (hereinafter referred to as the "List") or that are required to be notified by the World Organization for Animal Health (WOAH) and are related to the products of the "Protocol" has seriously affected the safety of wild aquatic products exported to China.

3. Major food safety incidents in Romania, major public health incidents in production companies, or pollutants in fishing waters have seriously affected the safety of wild aquatic products exported to China.

(3) Not directly or indirectly using drugs or additives banned in China, and using drugs or additives restricted or permitted by China in accordance with regulations.

(4) After inspection and quarantine by the competent authorities, no pathogenic microorganisms, toxic and harmful substances and foreign objects listed in Chinese laws and regulations were found, and no aquatic animal diseases listed in the "List" or that must be notified according to WOAH were found.

(5) The production process (including fishing, production and processing, packaging, storage, transportation, transit and export, etc.) should comply with China's relevant safety and health requirements and traceability requirements.

(6) Product packaging and labeling shall comply with China’s national food safety standards and relevant regulations on imported food safety management.

V. Certificate Requirements

Romania should implement inspection and quarantine of wild aquatic products exported to China in accordance with Chinese requirements, and issue a health certificate confirmed by both parties for each batch of wild aquatic products exported to China, proving that the batch of products complies with the relevant provisions of China's food safety laws and regulations. The certificate must be printed in at least Chinese and English, and English is the required language when filling in the certificate.

The health certificate should completely fill in the information of the wild aquatic products production enterprises exported to China. Romania should promptly provide the certificate sample and official seal to China for filing. If there are any changes, Romania should file a record with China at least one month before it takes effect.

6. Other requirements

China Customs will implement inspection and quarantine on wild aquatic products exported to China in accordance with China’s relevant laws and regulations on food safety, national standards and the provisions of the Protocol.

Destroy, return or otherwise handle unqualified products. For production companies that have serious problems or multiple substandard problems, China can take measures such as strengthening inspection and quarantine or suspending imports.
