China adds 20 Japanese entities to export control list

Xinhua News Agency, Beijing, February 24 (Reporters Xie Xiyao and He Xiao) The Ministry of Commerce issued two announcements on the 24th, deciding to include 20 Japanese entities on the export control list, and also decided to include 20 Japanese entities on the watch list. Both announcements will be officially implemented from the date of announcement.

The spokesperson of the Ministry of Commerce said that in accordance with the relevant provisions of laws and regulations such as the "Export Control Law of the People's Republic of China" and the "Regulations of the People's Republic of China on the Export Control of Dual-Use Items", China has decided to:

First, include Mitsubishi Shipbuilding Corporation and other 20 entities involved in enhancing Japan's military strength on the control list. The measures after listing mainly include two aspects. On the one hand, export operators are prohibited from exporting dual-use items to the above-mentioned entities. On the other hand, overseas organizations and individuals are prohibited from transferring or providing dual-use items originating in the People's Republic of China to the above-mentioned entities. Relevant activities currently being carried out should be stopped immediately.

The second is to add 20 Japanese entities such as Subaru Co., Ltd. that cannot verify the end users and end uses of dual-use items to the watch list. After listing, export operators who export dual-use items to the above-mentioned entities are not allowed to apply for a general license or obtain export certificates by registering and filling in information; when applying for individual licenses, they must submit a risk assessment report for the entities included in the watch list and provide a written commitment not to use dual-use items for any purpose that will help enhance Japan's military strength. The license review period is not limited by the time limit specified in Article 17, Paragraph 1, of the "Regulations of the People's Republic of China on the Export Control of Dual-use Items". The Ministry of Commerce will implement stricter end-user and end-use review of exports of dual-use items from entities on the watch list. Exports involving Japanese military users, military uses, and all other end-user uses that help enhance Japan’s military strength will not be approved. Entities included in the watch list may apply to be removed from the watch list if they fulfill their obligation to cooperate with verification in accordance with Article 26 of the Regulations of the People's Republic of China on Export Control of Dual-use Items. After verification by the Ministry of Commerce, it can be removed from the watch list.

The spokesperson said that for Japanese entities that are listed, measures in this announcement will be implemented; for Japanese entities that are not listed, if they involve Japanese military users, military purposes, or other end-user uses that help enhance Japan’s military strength, the export of dual-use items to them will be prohibited in accordance with the "Announcement on Strengthening the Export Control of Dual-use Items to Japan". The above-mentioned measures are aimed at stopping Japan's "remilitarization" and attempts to acquire nuclear weapons, and are completely legitimate, reasonable and legal. China's listing in accordance with the law only targets a small number of Japanese entities, and the relevant measures only target dual-use items and will not affect normal economic and trade exchanges between China and Japan. Japanese entities that are honest and law-abiding have nothing to worry about.
