01 What is a public safety video image information system?
The regulations clearly define the public safety video image information system, which refers to a system that collects, transmits, displays and stores video image information in areas involving public safety by installing image acquisition equipment and related facilities in public places.
02 Who is responsible for installing a secure video system in public areas? Article 7 of the Regulations stipulates that the public safety video system of public places such as major urban and rural road sections, road boundaries in administrative areas, bridges, tunnels, underground passages, squares, and areas surrounding key public security units shall be organized by local people's governments at or above the county level in accordance with the construction plan, incorporated into the public infrastructure management, and construction and maintenance funds shall be included in the government budget at the same level.

The following public safety video systems involving public safety areas shall be constructed by units that are responsible for the operation and management of the corresponding places in accordance with relevant standards. The key parts for installing image collection equipment shall be determined by relevant departments of local people's governments at or above the county level in accordance with the guidance of the division of responsibilities:
· Commercial centers, exhibition centers, tourist attractions, cultural, sports and entertainment venues, educational institutions, medical institutions, government service halls, parks, public parking lots and other places for gathering;
·Exit and entry ports (channels), airports, port passenger stations, navigable buildings, railway passenger stations, bus passenger stations, urban rail transit stations and other transportation hubs;
·Capital and medium-sized public transportation such as passenger trains, passenger cars, urban rail transit vehicles, and passenger ships;
·Service areas for expressways and ordinary national and provincial trunk lines.
The regulations particularly emphasize that no other unit or individual shall be allowed to install it except for relevant government departments and units with business management responsibilities, that is, public safety video system management units.
03 From April 1, the installation of image acquisition facilities in these areas is prohibited. The regulations also state that not all public places can install video image acquisition facilities, and areas that are prone to invading privacy are prohibited.
Image collection equipment and related facilities are prohibited from installing the following areas and parts of public places:
Inside rooms or private rooms where hotels, hotels, hotels, guesthouses, homestays and other accommodation places to operate reception and accommodation places;
Inside rooms in student dormitories, or rooms where units provide accommodation and rest services for internal personnel;
Inside rooms in public bathrooms, bathrooms, locker rooms, breastfeeding rooms, and fitting rooms;
Other areas and parts that can photograph, peep and eavesdrop on other people's privacy after installing the image collection equipment.
Units or individuals that are responsible for business management of the above areas and parts shall strengthen daily management and inspection. If image collection equipment and related facilities are installed in the areas and parts listed in the preceding paragraph, they shall immediately report to the local public security organ for processing.
04 Can individuals install cameras at their doorstep?
After the implementation of the regulations, can individuals still install cameras at their doorstep? Will this behavior be suspected of being illegal?
Experts said that the idea of court judges is usually to judge the installation method, angle and monitoring range of the camera, and should not affect the surrounding neighbors and infringe on the privacy of others. For example, if the camera can directly capture the faces of the neighbors and the interactions between people at the neighbor’s door, it will exceed the necessary limits of “protecting one’s personal safety and property safety” stipulated by law, and there is a suspicion of infringing on the privacy of neighbors.

05 What penalties will be faced when illegally installing image collection facilities?
For those who illegally install image collection equipment and facilities, or illegally provide or publicly disseminate video image information, the equipment and facilities shall be confiscated, video image information shall be deleted, and a fine shall be imposed; those who peep, secretly take pictures, or eavesdrop on other people's privacy shall be imposed in accordance with the law; those who illegally obtain state secrets or military secrets shall be punished in accordance with the relevant laws; those who constitute a crime shall be held criminally liable in accordance with the law.
The business management units or individuals who fail to fulfill their daily management and inspection obligations and cause serious consequences will be fined and punished. According to the severity of the circumstances, the business will be suspended or business will be suspended or business license will be revoked.
