CCTV News: According to the "Window of the Capital", the Beijing Municipal People's Government issued a decision on revoking a batch of administrative law enforcement powers. From April 1, 2025, 12 administrative penalties and related administrative inspection powers in urban road management, urban lighting management, river and lake protection management, construction (domestic) waste management, etc., will be revoked to the District Urban Management Law Enforcement Bureau for exercise; 6 administrative penalties for controlling smoking and related administrative inspection powers in the District Health Commission for exercise; 2 administrative penalties for producing noise interference, clothing dry cleaning and motor vehicle maintenance, and other projects, and related administrative inspection powers in the District Ecological Environment Bureau for exercise.

Decision of the Beijing Municipal People's Government on the Recovery of a Batch of Administrative Law Enforcement Powers

People's governments of all districts, committees, offices, bureaus, and municipal agencies:

In accordance with the "Administrative Penalty Law of the People's Republic of China", "Administrative Compulsory Law of the People's Republic of China" and "Beijing Street Office Regulations" and other relevant laws and regulations, in accordance with the Party Central Committee's comprehensive establishment of a list of matters for townships (streets) to perform their duties, and effectively reduce the burden on grassroots units, the Municipal Government decided to reclaim a batch of administrative law enforcement powers delegated to townships (streets). The specific content is as follows:

1. Starting from April 1, 2025, 12 administrative penalties and related administrative inspection powers in urban road management, urban lighting management, river and lake protection management, construction (domestic) waste management, and related administrative inspection powers will be reclaimed to the District Urban Management Law Enforcement Bureau for exercise; 6 administrative penalties for controlling smoking and related administrative inspection powers will be reclaimed to the District Health Commission for exercise; 2 administrative penalties for noise interference in production and operation activities, garment dry cleaning and motor vehicle maintenance and other projects, and related administrative inspection powers will be reclaimed to the District Ecological Environment Bureau for exercise.

2. The relevant departments of the municipal government should attach great importance to it, guide all districts to implement the work of reclaiming administrative law enforcement powers, and further refine supporting measures. All districts should unify their thinking and organize relevant departments of the district government and townships (streets) to make a good job in revoking administrative law enforcement powers in accordance with the "Notice of the General Office of the Beijing Municipal People's Government on Issuing the "Rules for the Coordination of Administrative Law Enforcement Work during Institutional Reform" (Beijing Government Office [2018] No. 42).

Due to changes in laws, regulations and rules, if the items in the list of administrative law enforcement powers need to be changed, the matters merged, and the authority division adjustments are required, the relevant provisions on dynamic management of the list of powers shall be implemented in accordance with the relevant provisions on dynamic management of the list of powers, and the municipal government will no longer make any other decisions.
